Terms of Service

These Terms of Service ("ToS") govern your use of AskExpert services, including AI-driven customer interaction tools, expert response platforms, and partner services. By accessing or using AskExpert, you agree to these terms. Please read them carefully.

1. General Provisions

AskExpert provides subscription-based services to businesses, including AI chatbots and tools to enhance customer interactions and support. These ToS apply to all business Partners using our services. By registering and using our services, you accept these ToS and agree to abide by them. Services are provided subject to these ToS and any additional agreements explicitly agreed upon in writing.

2. Definitions

  • AskExpert ("Service Provider") – The entity providing AskExpert services.
  • Partner – A business entity subscribing to and utilizing AskExpert services.
  • Services – Subscription-based tools, including AI chatbots, expert response platforms, and dashboards.
  • User – End-customers engaging with AskExpert services through a Partner’s platform.
  • Content – Queries, AI-generated responses, and other materials created or managed through AskExpert services.

3. Service Subscription

Partners must complete registration, accept these ToS, and submit an order form to access services. Subscription terms and pricing are specified in the order form and billing plan. Upon activation, Partners gain access to a dashboard to manage their subscription and services. Services are provided for agreed durations and renew automatically unless terminated in accordance with these ToS.

4. Partner Responsibilities

Partners agree to:
✔ Provide accurate and updated information during registration and subscription.
✔ Use services as intended and comply with all applicable laws and regulations.
✔ Notify Users that AI-generated responses may require verification and should not replace professional advice.
✔ Moderate content (if applicable) and ensure compliance with data privacy and intellectual property laws.
✔ Ensure their personnel properly implement and use AskExpert features as outlined in technical and training documentation.

5. Pricing and Payment

  • Fees are detailed in the order form and depend on the chosen subscription plan.
  • Payments are due within 30 days of invoice issuance. Late payments may lead to service suspension or termination.
  • All prices are exclusive of applicable taxes, which will be added as required.
  • Payment methods and schedules are outlined in the order form.
  • Additional costs, such as transaction fees, are borne by the Partner.
  • Non-payment exceeding 14 calendar days may result in service suspension. Full access is restored upon receipt of due payments.

6. Intellectual Property

  • AskExpert retains ownership of all proprietary materials, including software, algorithms, and documentation.
  • Partners are granted a limited, non-transferable license to use the services during their subscription period.
  • Unauthorized modification, distribution, or reverse-engineering of the software is strictly prohibited.
  • Any content generated by the Partner or AI tools provided by AskExpert during the subscription remains under the ownership of the Partner.

7. Data Privacy

  • AskExpert processes personal data as described in its Privacy Policy and Data Processing Agreement.
  • Partners must obtain any necessary consents from Users for data collection and usage.
  • Data security is managed through trusted third-party providers as outlined in our policy.
  • Any personal data submitted through AskExpert services must comply with applicable laws, including GDPR.

8. Limitations of Liability

  • AskExpert provides services "as-is" without guarantees of uninterrupted performance.
  • AskExpert is not liable for indirect damages, such as loss of profits or operational disruptions.
  • Partners are responsible for ensuring the accuracy and legality of the content provided to their Users.
  • AskExpert is not responsible for delays caused by external factors such as internet disruptions or force majeure.

9. Termination and Suspension

  • Either party may terminate the subscription by providing written notice 14 days before the end of the billing cycle.
  • AskExpert may suspend or terminate services for non-payment, breach of these ToS, or misuse of the platform.
  • Upon termination, access to services will cease, and Partners must remove AskExpert tools from their platforms.
  • Prepaid subscription fees are non-refundable in the event of termination.

10. Technical Requirements

  • A stable internet connection and an up-to-date web browser are required to use AskExpert services.
  • Partners must implement the provided API on their website in compliance with AskExpert's technical specifications.
  • Regular updates and integration testing are recommended to ensure smooth operation.

11. Content Management

  • Partners may choose to moderate content manually or allow it to be published without prior review.
  • Content flagged as inappropriate or in violation of applicable laws will be removed promptly.
  • Partners are responsible for ensuring that content published through AskExpert services complies with all applicable legal and ethical standards.

12. Governing Law and Disputes

  • These ToS are governed by the laws of Poland.
  • Disputes will be resolved by the courts of Poznań, Poland.

13. Service Availability and Support

  • AskExpert aims to provide 98% service availability monthly.
  • Planned maintenance will be communicated at least 7 days in advance.
